Welcome to CarIntel! These Terms of Service ("Terms") govern your access to and use of the CarIntel mobile application and related services (collectively, the "Services") provided by CarIntel LLC ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

In Short: By using CarIntel, you agree to these Terms of Service.

By downloading, installing, or using the CarIntel application, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and CarIntel LLC.

We may update these Terms from time to time. Your continued use of the Services after any changes indicates your acceptance of the updated Terms.

2. Eligibility

In Short: You must be at least 18 years old to use our Services.

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

In Short: You are responsible for maintaining the security of your account.

To access certain features of the Services, you may need to create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

4. Subscription and Payments

In Short: Premium features require a paid subscription that automatically renews.

Free and Premium Tiers

CarIntel offers both free and premium subscription tiers. The free tier provides limited access to basic features, while the premium tier ("CarIntel Premium") unlocks additional features including unlimited vehicle checks, AI-powered analysis, and more.

Auto-Renewal

Premium subscriptions automatically renew at the end of each subscription period (yearly) unless you cancel before the renewal date. You will be charged through your Apple ID account.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until then.

Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not directly process refunds for subscriptions purchased through the App Store.

In Short: CarIntel provides AI-powered tools to help you make informed car buying decisions.

CarIntel is an AI-powered mobile application designed to assist users in the car buying process. Our Services include:

Vehicle information lookup and analysis
Market value estimates and price predictions
Vehicle history insights
Comparable sales data
AI-powered negotiation recommendations
PDF report generation
Price tracking and alerts

6. AI-Powered Features

In Short: Our AI features provide estimates and recommendations, not guarantees.

CarIntel uses artificial intelligence and machine learning to provide vehicle analysis, market predictions, and recommendations. You acknowledge and agree that:

AI-generated content is provided for informational purposes only
Market value estimates are approximations based on available data
Predictions and recommendations are not guarantees of actual outcomes
You should independently verify important information before making purchasing decisions
We are not responsible for decisions made based on AI-generated content

7. User Conduct

In Short: Use our Services responsibly and lawfully.

You agree not to:

Use the Services for any unlawful purpose
Attempt to gain unauthorized access to our systems or networks
Interfere with or disrupt the Services or servers
Reverse engineer, decompile, or disassemble the application
Use automated systems to access the Services without permission
Resell, redistribute, or commercially exploit the Services
Violate any applicable laws or regulations

8. Intellectual Property

In Short: We own all rights to our Services and content.

The Services, including all content, features, and functionality, are owned by CarIntel LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our express written permission.

9. Disclaimer of Warranties

In Short: Our Services are provided "as is" without warranties.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any information provided through the Services, including vehicle valuations, market predictions, and AI-generated recommendations.

10. Limitation of Liability

In Short: Our liability is limited to the maximum extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARINTEL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

In Short: You agree to indemnify us against claims arising from your use of the Services.

You agree to indemnify, defend, and hold harmless CarIntel LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Termination

In Short: We may terminate your access to the Services at any time.

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by discontinuing use of the Services and canceling any active subscriptions through your Apple ID account settings.

13. Changes to Terms

In Short: We may update these Terms and will notify you of material changes.

We may modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, providing additional notice within the app.

Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

14. Governing Law

In Short: These Terms are governed by the laws of the United States.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts of the United States.
